DMK Govt Moves SC, looking for a resolution of JayalaLalitHAA treatment investigation

New Delhi: DMK Government Tamil Nadu on Monday asked the Supreme Court to order the commencement of the investigation by the Justice (Pension) of the Arumughaswamy commission into the truth, adequacy and lack of treatment of former Timur Minister J Jayalalithaa, who exhaled his breath in December 2016 after 75 days of treatment at the Apollo Hospital.
The work of the Government of Arumughaswamy, which was founded on September 25, 2017 by the AIDMK government, lives in SC on April 26, 2019 in the Petition by the Apollo Hospital that accused the commission biased in hospitals, as proven from the way to conduct a trial and gave a statement.
Judge S Abdul Nazir and Krishna Murari agreed with senior advocate Dushyant Dave to hear the fresh request of Tamil Nadu for the initial completion of the work by the investigation commission led by Justice Arumughaswamy.
The Government DMK’s request to obtain a COI report on the standard of care, the adequacy and disadvantage is bound to create a fresh storm in the state, especially in AIDMK which faces a difficult time after losing the assembly of polls.
Now in opposition, cadres and AIADMK workers may face upheaval of COI reports and can be used by trust and aide JayaLalitHAA and AIDE V K Sasikala, who recently announced it back into politics.
How it will be beneficial to the DMK government is the time to tell.
Sasikala’s advice Amit Anand Tiwari told SC that he had more witnesses to be examined and that he had to get an adequate opportunity to produce witnesses before the commission.
The Government of MK K Stalin through Advocate Joseph Aristotle told SC that the Arumughaswamy commission had completed 90% of his work on April 26, 2019, when the SC remained in the process.
“The Commission has completed an examination of 154 witnesses involving 56 doctors attached to Apollo Hospital, five doctors from AIIMS, 12 government doctors including the medical council of five doctors formed by the Tamil Nadu Government, 22 paramedics and paritive staff and others and 59 witnesses Other witnesses.
Therefore, around 90% of the trial before the commission has been concluded, “he said.
It was said by the state government “raises expenditure of 4,26,462 per month towards salary for the investigation commissioner staff and therefore, will be the interests of justice that the Commission is permitted to conclude the reference and send a final report to the Tamil Nadu government quickly.” Appears for COI , Senior Advocate Ranjit Kumar also told SC that it would be the interests of all that commission requests complete their work and submit the report as early as possible.
However, it appeared for the Apollo Hospital, Senior Advocate C Sundaram said that the problem would need the final adjudication rather than just vacationing from a two-year stay.
He said a cross examination from the witness was not finished.
SC agreed to post hearing cases that were delayed for final disposal in August.
The TN government brings the SC Madras notification of the High Court entertaining pills and asking the country why the Commission does not have to be directed to submit its final report and end its business within three weeks.
HC has fixed August 13 as the next hearing date on the pill.
