New Delhi: Deputy Minister of Manish Sisodia on Saturday fired a four-page letter to Lieutenant-Governor of Baijal, asking him to stop holding a meeting with Delhi government officials who fell under the chosen government jurisdiction.
He said this had happened for the past three months.
“I have known that you call officers for meetings, without telling ministers, in subjects that fall under the jurisdiction of the elected government and give them instructions.
Then, officials from the Lieutenant Governor’s office put pressure on officials to implement instructions,” Writing Sisodia.
SISODIA: LG action on the 2008 SC decision, the killing of democracy he called LG actions was not constitutional and against the government of the Supreme Court of Supreme Court, added that it amounted to the murder of democracy.
He said he had done a lot of contemplation before writing the letter and it was important for democracy and the constitution.
“If the LG appointed in the midst of surging the elected government and make decisions about all subjects, the democracy achieved after many struggles and sacrifices by our ancestors and freedom fighters will be destroyed,” he added, adding to it against the vision of freedom fighters.
“The constitution clarifies that the limitation of three subjects (land, police and public order), you will work in accordance with the decision taken by the government selected in all subjects.
Because Delhi is the National Capital, the Constitution has provided veto power to LG that he can express Definement of opinion if he does not agree with the decision of the elected government, “Sisodia said.
However, he also showed that the Supreme Court Constitutional bench on July 4, 2018 ordered that LG could use this power in a very rare case.
Sisodia’s letter contains two paragraphs from the SC assessment which states that LG has not been entrusted with the strength of independent decision making.
“The Constitution only gave two strengths on LG – whether he agreed with the decision of the selected government or in the case of disagreement, he could refer to the President’s problem.
SC also stated that LG had been given the power to refer to the president of a dispute only in a very extraordinary case,” Sisodia said.
He said that because LG had been appointed by the BJLED Central Government, BJP officials might suppress him to work against the AAP government.
“I want to remind you that you are a respectable LG Delhi,” Sisodia wrote.
He said that Anil Baijal could be LG only because India was a democratic country and provided the same opportunity for all, regardless of the caste and creed.
“If democracy is destroyed, the future generation will lose this opportunity.
Democracy has given you this position and strength.
Now, your job to protect the democracy and the future of the country,” he said.
“As LG, you have the opportunity and you can use it to do work that will leave weaker democracy for future generations.
History will remember you as a good person but people who weaken democracy.
