Mumbai: The National Investigation Agency (NIA) on Friday told the Bombay High Court in an oral statement that it would not take coercive actions against Varavara Rao poet activists until September 6 when his application for medical guarantee extensions would be heard.
Rao, a person accused of the case of Elggar Parishad-Maois Links and currently on medical guarantees while given by HC in February this year, it should have surrendered before the Taloja prison authority on September 5, before the judiciary of SS Shinde and NJ Jamadar on Friday .
However, due to lack of time, this problem cannot be heard.
HC said he would hear Rao’s request on September 6 then urged HC to ensure no coercive action taken against Rao until then.
The additional lawyer General Anil Singh, who appeared for Nia, in a oral statement said, “We will not take the action of coercion until the next hearing.” On February 22 this year, SS Shinde’s justice bench and Manish Pitale have given RAO (82) temporary medical guarantees on “humanitarian land.” At that time, Rao, suffered several diseases, was undergoing treatment at Nanavati Hospital in Mumbai after shifting out of Taloja prison after court intervention.
At that time, HC had said if it did not provide RAO medical guarantees, it would reach its duties to protect the principles of human rights, and fundamental rights of citizens of life and health.
The bench has imposed a strict guarantee condition, including the direction for Rao to remain in the jurisdiction of the Mumbai Nia court for the period he comes out with a guarantee, and forbid it to establish contact with its accusation in this case.
