Mumbai: The National Investigation Agency (Nia) told the Bombay High Court on Friday that the accusation of the defendant in the case of Maoist Parishad would not be framed until August 25.
Limitation of costs – After that the experiment in the Special Nia Court will take place on August 23, but the defendant’s lawyer moved the High Court by saying that they had not received certain major documents from prosecution.
Yug Chaudhry’s senior advocate, representing the Sudha Bharadwaj activist, told HC that he and was accused of another not received a copy of the draft fees submitted by Nia.
Also, certain applications submitted by the defendant including one for clone copy of the evidence have not been decided by a special court so far, he added.
Advocate Sandesh Patil, lawyer Nia, told Judge S Shinde and J Jamadar that the central body would not continue by framing the accusations until Wednesday.
“We will get a delay (from a special court).
This court (HC) might hear a problem on Wednesday and until then we will not continue by framing the cost.
We will also provide relevant documents to the Mr Chaudhry client in Indonesia while that , “Patil said.
On August 9, Nia filed a draft cost before a special court against 15 defendants.
They put around 20 charges summoned by the defendant based on the Criminal Code Law India and the activity (prevention) that violated the law.
After the draft fee was filed, the court heard the defendant on each count and ‘frame’ accusation after the trial began.
