Brussels: The recent law was introduced in Hungary regulating marriage and the risk of gender identity discriminating against LGBT people and should be included in citizens for public consultations before they pass, European human rights watchdog Tuesday.
Among other things, changes in the Hungarian Constitution in December 2020 changed the family’s definition to exclude the transgender and other LGBT individuals, defining the family’s basis as “marriage and relations of parents.” It stated that “Mother is a woman and the Father is a man.” Commission Venetian – Advisory Group on Constitutional Problems for the Council of 47 European Human Rights Agency – said the “Omnibus Law” Hungary can limit adoption to heterosexual parents.
“This constitutional amendment should not be used as an opportunity to attract existing laws about individual protection that is not heterosexual, or to change this law for their losses,” he said in the analysis and opinion about the law.
Constitutional same-sex marriage is prohibited in Hungary, but civilian partnerships are recognized.
The action states that only married couples can adopt children unless given a special permit by the Minister of Family.
This effectively makes the same-sex partner or single individual do it.
The Commission said that clear criteria must be set to limit the “new discretionary power” from the minister to provide or reject approval for adoption by single people.
This, it is said, it will help ensure the principle of nondiscation, including based on sexual orientation and gender identity.
The European Council is not part of the European Union, but the opinion of the Venetian Commission is calculated by the EU executive branch when weighing whether it will take action against one of the block member countries on the possibility of a decline in democracy.
The European Commission and EU parliament have launched the action of “legal rules” against the government of Hungarian Prime Minister Viktor Orban.
If the four fifths of the 26 EU Hungarian partners agree “There is a clear risk of serious violations” from block values, Budapest can lose his voting rights.
The EU Agreement said the block “was established in the values of respect for human dignity, freedom, democracy, equality, the supremacy of the law and respect for human rights, including the rights of people owned by the minorities.”
