Mumbai: The Bombay High Court on Monday said the late Jesuit Priest, Fr Stan Swamy, was accused of the case of Elas Parishad 2018, “providing services to the public”.
Overcoming the Undertrial problem that cooled long in prison, HC said, “(we) cannot set aside human considerations when deciding on the medical guarantee application.” “We respect his work.
Legally, whatever there is (a) a different problem,” Judge S Shinde and J Jaradam said while hearing the advice of Stan Swamy about the need for a detailed investigation of his death.
It observed that he was “extraordinary,” “the type of service he rendered to the community.” Judge Shinde added that he usually did not have time to watch TV, but saw online funeral services for Swamy booths.
“It was very dignified and graceful.
With elegant and respectful they did it.” Stan Swamy, 84, died on July 5 when he was at the hospital in Bandra, after undergoing treatment and had recovered from Covid-19 after his confession.
Shinde judge led on May 28 was directed that the tribal rights activist from Ranchi immediately shifted to a private hospital from prison.
“How many years do people have to languish in prison? Not just this case but the other too?” Asked the bench on Monday.
Senior adviser Mihir Desai, who represented the late Stan Swamy, asked HC to allow FRAZER Mascarenhas, former Principal of St Xavier, to participate in a legisterial investigation mandated legally to death, as the next relative and that the report was handed over to HC.
“What must be considered is what caused the cause of his death,” Desai said.
The High Court Judge said that it did not have control of what people said outside the courtroom but stated that it had ensured that FR STAN was accused, who was sick, medical attention.
