On November 19, 2015, the police focal point has ordered 28-year-old Amitpreet, who lives in Moti Nagar in Ludhiana, and Jaswinder Singh of Gill Chowk 35 years old (murder) and 120 B (criminal conspiracy)) IPC for Shashi Shekhar’s murder from Moti Nagar.
In his complaint, Nashad from the Mohalla Jain colony in the Moti Nagar area had alleged that around 7:15 a.m.
on November 19, 2015, he and his older son Shashi Shekhar was disturbed over a loud voice played by stereo by Amitpreet Singh, who lives in House of Jaswinder Singh.
Shashi asked Amitpreet to reduce stereo volume.
But Amitpreet began to abuse Shashi and then attack his son and stab him with a knife.
His son died later.
The prosecution said the motive behind the crime was hostile because the owner of Vehra Jaswinder Singh had a fight with Shashi on previous occasions as well.
Amitpreet and Jaswinder are used to create interference in Mohalla after consuming liquor.
The police then arrested the defendant and filed Chargesheet against them in court.
During the case of the case, the defendant asked for innocence.
Defense advisers argue that prosecution has not been able to connect the defendant with a violation commission.
There was no convincing and convincing evidence about the record to connect the defendant with a violation commission.
All prosecution cases depend on the testimony of Amita’s complainant, the lame of the late, his wife Sonia and Jappan Kumar, who were close to Shashi Shekar’s relationship that had died.
There were no other independent witnesses from the area where the occurrence had been examined by prosecution to strengthen the statements of these witnesses, who were interested in seeing the success of prosecution cases.
The court argues that the impression submitted by defense advisors has no achievements.
It observed that the presence of Anita and Sonia’s eyewitnesses in a place could not be doubted in any way.
The court argues that the testimony of these witnesses cannot be trusted only for reasons related to the deceased.
“In general, it can be seen that a relationship will not hide the culprit and make accusations against innocent people.
However, in such cases, the court is required to adopt a careful approach and analyze the evidence to find out whether it is a change and credible evidence.
, There is no reason or opportunity for Anita, the mother of the deceased and Sonia, the wife died, to make false charges against the defendant, “said the court.
“Even if not, it is now well resolved that the testimonies of the witnesses cannot be doubted only because of their relationship with the deceased”.
The court observed that prosecution had failed to prove the case against Jaswinder Singh under Section 302/120-B from the IPC.
