Gurgaon: The Director of the Developer of the PJK has been booked in the direction of the local court for allegedly collecting money from buyers on behalf of the real-estate project and failed to hand over ownership to them.
Developers were accused of not completing the project even though several years delayed and took up a large portion of the buyer.
Project, meanwhile, still ‘non-starter’.
A case was registered with the complaint of the buyer of the Vann PJK Housing Project in Sector 71.
The buyer accused that despite making complaints repeatedly to the police, there were no actions taken against the developer.
Finally, FIR was registered in the direction of the court.
However, the developer claimed that the project was delayed because of Covid-19 and other reasons beyond their control and now they are trying to revive the project.
Pawan Kumar Jain, a citizen of Sector 54, accused him of being captivated to buy a 3BHK flats measuring 1,941 Sqft in 2014 in the project.
Payment is related to construction but the developer allegedly continues to increase the demand from buyers and reporter pays around Rs 50.5 lakh.
The flat should be sent in 2018.
“This project was abandoned by the developer and there was no hope of completing the project in the near future,” Alleged Jain, added that there was no work that occurred in the construction site.
Until now, developers have not taken steps to complete the project.
He said the project remained non-starter and developers did not disclose facts and did not return investor money.

In 2018, the developer closed the office of his site and released banners and posters of the ground.
“We have faced extraordinary financial stress due to the delay in completion of the project because we have to pay rent and interest,” Jain said, adding that during a visit to the developer’s office they were not permitted to meet with the company director.

Buyers also filed complaints with Hrera.
He alleged that the developer submitted a statement with false and reckless facts that the construction swung was full, and the project would be finished soon.
“The lie was exposed before Hrera and the authorities issued orders for the company,” Jain said.
“The company deliberately raises funds from clients to deceive and deceive them.
It hides facts, the actual project position and land development / progress in the location, and utilizing honesty and complainant faith,” Jain said.
In the direction of the court, a case was registered against the developer and director of PRD at the Badhshahpur police station under Section 420 (cheating), 406 (criminal violations of trust), 120B (criminal conspiracy) and 506 (criminal intimidation) IPC.
Gaurav Mittal, Managing Director of the Developer of PJK, said the project was postponed to Covid-19 and the factors beyond their control.
“We are at a very sophisticated stage of the project’s revival,” Mittal said, added that they would hand over the flat after completion.
