FIR Inchinghing: No SC relief for Deshmukh

Mumbai / New Delhi: Although the Supreme Court did not bear the temporary protection against coercive actions in the alleged money laundering case investigated by the enforcement directorate, former Interior Minister Anil Deshmukh could still file a pre-arrest guarantee before the trial.
court.
A SC Special Judge consisting of Judge A M Khanwilkar, Krishna Murari and V Ramasubramanian on Monday told advisers Deshmukh that he had alternative medicine under the criminal procedure code (CRPC) for assistance.
Under the CRPC, a criminal law expert said, if a case was registered or investigated against someone, he could seek anticipatory guarantee before the High Court.
A legal expert said Deshmukh also had the choice to challenge the ed process before the High Court and seek temporary protection.
Advocate Kamlesh Ghumre, who represents Deshmukh, said on Monday, “We will make the right decision after studying the temporary order.” On August 6, the Enforcement Directorate (ED) carried out a raid in three places to look for Deshmukh and to gather evidence.
Raid continued until late at night but Deshmukh could not be traced, the agency said.
Following SC orders, the Directorate of Enforcement hopes that the former Minister of the House will surrender and join a money laundering investigation delayed by him.
Source Ed said, “Ed expected Deshmukh to appear before recording his statement in this case, as he promised in the video he released before.
Ed stipulates a trail of Rs 4.7 Crore bribery collected by Sachin Waze, where Dishmukh is a beneficiaries.
Ed needs to question Deshmukh about the transaction.
“Previously an ED official said the action could be taken against Deshmukh because of avoiding a call, because the court had not given him temporary protection in this case.
According to agency, the former Minister of Home and Senior NCP leaders have spent all his choices because he hasn’t worked with the probe, avoiding repetitive calls and has escaped – all criteria meet the conditions for arrest.
