New Delhi: The absence of cooperative federalism between the center and the Delhi government is not new.
They have been in Loggerheads for years.
But 2021 was marked by a tectonic shift in central-AAP relations.
Over the years, the Governor of Lieutenant and the AAP government has been fighting for excellence in government and decision making.
The biggest victim is governance and community welfare because many schemes are jammed and bureaucrats have a crisis crisis.
The center tells the NCT government law from Delhi (amendment) in April, which caused significant changes in the functioning of the state.
It attracts the strength of the elected government and bestows them on LG.
Now, the AAP government requires LG approval before taking executive actions under any law because the amendment clarifies that LG is now “government”.
Notice states: “…
before taking any executive action in pursuing the decision of the Council of Ministers, to carry out the strength of the government …
under any law that applies in the capital, the opinion of the Governor of Lieutenant in terms of clauses (4) Article 293AA Constitution will be obtained On all things as specified, by public or special orders, by LG.
“Against the hard amendment, Chairman of the Minister of Arvind Kejriwal joined the protest by AAP in Jantar Mantar demanding withdrawal of actions, calling it unconstitutional and undemocratic.
He claimed that the action was brought to deceive Delhi and stopped progress and development.
July witnessed a prolonged strip between the LG and Delhi government about the appointment of lawyers to handle the agricultural stirrer case and the appointment of three public prosecutors for the case of the Northeast Delhi riot.
The file was sent by LG to the President quoted differences with selected governments.
This is the first example of LG which mentions such a problem to the President.
The other main lines erupted the jection in public through tweets by calling non-constitutional meetings.
He also said the meeting was against the assessment of the Constitutional Court of the Supreme Court and if LG had questions, he could ask the council of the minister instead of holding direct meetings with officials.
However, the situation on the ground doesn’t seem too chaotic.
Administration functions smoothly, but not without the upheaval of the LG government which has become a characteristic in recent years.
An official said the administrative decision was not delayed because the LG office already had a mechanism to delete files.
Special focus is given to urgent files and they are discarded on priority.
A retired bureaucrate said the anxient action would not have a big impact on the selected government function for now, but the status quo could change in the future.
The former official added that LG was made “real boss” by parliament and there was plenty of space for him to intervene in the administration if he felt suitable for greater public good.
Over the years, LG and the AAP government has struggled to excellence in government and decision making.
The biggest victim is governance and general welfare because many schemes are trapped in August after LG Anil Baijal held a meeting to review the Covid-19 situation and future preparedness with the Secretary of the Head, Secretary of Division, Secretary), Secretary (Health), DMRC Implementing Director and other officials.
Kejriwal objected to this meeting and suggested LG to avoid direct meetings with officials without involving the elected government.
