Mumbai / Jaisalmer: Additional District Judge (ADJ) in Jaisalmer on Tuesday gave a guarantee to the former Chairperson of the SBI Pratip Chaudhuri, which was sent to a 14-day trial judge (CJM) from the city on November 1.
Meanwhile, the Rajasthan High Court also still received the CJM command to arrest the Director and employee of the Alchemist assets reconstruction company, where Chaudhuri was a director.
ADJ was given a bail Chaudhuri with a personal guarantee of Rs 1 Lakh and Rs 50,000 deposit.
He has been asked to attend the court on November 15.
After being released, Chaudhuri was accepted by family members.
HC has passed Stay Order in two petitions submitted by the Board of Directors and by Arch Arc employees.
During hearing, advocates for the applicant showed that similar FIR was submitted by the previous complainant but the same thing was canceled by the Supreme Court.
Chaudhuri was arrested by Jaisalmer police on November 1 based on a complaint submitted by the Godawan Group promoter who had taken loans in 2007 for the Hospitality Project of Garh Rajwada.
SBI then classified accounts as non-performing assets and loans sold to Arcis Arc a few months after Chaudhuri retired.
Chaudhuri then joined Alchemist as director.
Assets are finally sold under the process of bankruptcy despite the debtor’s efforts to stop the process in various courts.
“We have submitted a petition in HC below Section 482 from the criminal procedure code to cancel the FIR also order 12.2 20 taking knowing complaints.
HC has fixed orders and subsequent orders.
Also, well Adj and Jodhpur bench from Rajasthan HC said that this is a civil process, “Alok Dhir said, Director at Alchemis Arc.
“It is unfortunate that the chronic protection that has not paid a penny for 13 years after taking a loan can get someone from the captured Chaudhuri stature.
This is a sad comment about the legal system that the recovery process by lenders has been given the color of crime,” said Dhir.
“The accusation is that security is underestimated by SBI.
In this case, what is sold is not his but a loan.
Recovery is done by the IBC process and the property is sold to the highest bidder approved by NCLT,” he added.
“Even though we protested gave him a guarantee, said the Justice Court Dalpat Singh Choudhary, while looking at his age, receiving a guarantee petition,” Rathore said.
According to Dhir, the complainant has been involved in the ‘Forum shopping’ throughout.
After the original fir was closed in 2015, they filed the next firefighter which was canceled by the Supreme Court.
Around the same time, they submit a request for protest against the original closure of evera.
