Gahati HC came to save two jumbo sold to Odisha Man

Guwahati: The Gahati High Court has come to save two elephants, Lakhi Prasad and the day of Prasad, which was temporarily confiscated by illegally on commercial considerations from Arunachal Pradesh to Edisha through Assam last April.
Justice Rumi Kumari Phukan, in August 2, canceled the previous order by additional judge sessions, no.2 (FTC), Tinsukia, who had given elephant custody for Chow Sonjit Pomong, the defendant, was faked from Arunachal.
Pachyderms is now in custody from the Department of Forest and Wildlife Assam and has been stored in Kaziranga National Park.
The Assam Forest Department believes that almost 200 elephants from the region have become victims of developing rackets and sold to various states outside the area, which are illegal.
In a statement to Assam Forest Officials, Pomong admitted that one Barun Kumar Singh had transferred Rs 9 Lakh to Lakhi Prasad and Rs 17 Lakh for the day of Prasad to his account.
Pomong also stated that Singh approached him to look for elephants and also prepared documents on his name.
He specifically stated that the process of selling elephants began in 2017 when he met Singh used to provide cash to his brother’s family, Chow Moloy Pomong, for elephant sales.
The judge noted that the defendant, Pomong, in his statement, said Barun Kumar Singh had told that elephants would be used for religious purposes.
But I have not received documents from any temple or he cannot reveal religious organizations where elephants will be transported, the judge states.
“More importantly, respondents No.1 / accused further admitted about the money transaction for elephant transfers in his bank account from the account of Barun Kumar Singh.
Given the statement of recognition like that is done by respondents No.1 / accused of 07.06.2021, clearly that Elephants are transported by commercial considerations that violate section 43 of the law, “note the judge.
The two elephants claimed to be Pomong as theirs were transported in a truck from Lathao in the Namsacha Pradesh district for one Rabindra Kumar Singh from Shastri Nagar in Coraput Regency in Odisha.
The vehicle was stopped by the Doomdoom Division Forest Officer in Tinsukia Assam district and the animals were saved.
Truck driver Meghan Kumar and Barun Kumar Singh, arrested.
Pomong was approaching the CJM court in Tinsukia who was looking for detainees from both elephants who claimed to be the owner but his request was rejected.
He then approached the court revision and on June 24, additional judge sessions, No.
2 (FTC), Tinsukia, allows revised revisions and elephants to be returned to prisoners.
The Assam government challenged the revision of the court in the high court on the grounds that the two elephants were transported illegally because there were no valid documents such as transit permits to transport animals outside the country or the recipient’s organization agreement.
In addition, there is also no intimacy from Arunachal authority to Assam on the movement between elephants.
