Greater Noida: Overriding the orders of the High Court of Allahabad who rejected police disputes to send charges in gangster laws for prison, Police Bibrakh arrested another member of the Anil Dujana gang ordered in the same case and produced it before.
Taking attention to the orders of the High Court, the District Additional District and Judge Session Manoj Kumar refused the police request for the detention of Chandrapal Pradhan accused.
Chandrapal Pradhan from Bambawad Village, who is also a member of Anil Dujana Geng, according to the police, was arrested earlier this week in connection with the Gangster Act Case submitted against him and 34 others were accused of February 2019.
He was produced before the court who heard the REMAND application on Tuesday.
Pradhan’s lawyer Anuj Nagar told TII that in this case nested under the Gangster law in 2019, 34 others were also ordered and some had approached Allahabad High Courct.
“Three FIRS filed against three different gangs.
While the police Bibrakh had ordered Anil Dujana and 34 gang members under the Gangster Law, Dadri police had ordered members of Randeep Bhati Geng while the Danka police had ordered members of Gang Sunder Bhati,” he said.
Nagar said one of the one who was accused of nesting against the Anil Dujana Geng member identified as Virender went to the High Court which remained a proceedings of the case in February 2020.
“Even though the court remained a proceeds of all cases, the police continued to do the arrest in this case.
On February 14, 2020, Sonu Nai aka Jitender was arrested but the police application to send him to the guardians of the heart was rejected, “he said.
However, on Saturday and Sunday, police Bibrakh arrested two gang members from Anil Dujana Geng whose detention application could not be heard by the Special Judge Court (Gangster Law).
“Therefore the weekend and the court did not function those days, only a general remand judge who had sat that day and so the detention application could not be heard,” he said.
However, when Chandrapal was produced before the court on Monday, a special court (Gangster ACT) functions and he heard the bail application.
“The court rejected the detention application quoted a sequence of high courts in all cases,” he said.
In the order, the court noted that the High Court had lived further actions in connection with this case.
“At this stage, there was no legal basis for the arrests accused and applying for sending him to judicial detention.
The legal opinion of the prosecution officer that the February 2020 High Court order only applies in the case of virender unacceptable,” said the court in its order.
However, police Bibrakh decided to appeal against the court.
