Chennai: Five days after the Tamil Nadu government appointed a retired judge as the head of the fourth police commission, Madras High Court has directed the country to clarify whether the appointment is in accordance with the rules.
The first bench from the chairman of Judge Munishwar Nath Bhandari and Justice P D Audikesavalu issued the direction on Monday, indicating that only the secretary of the country’s house had to lead the commission according to the rules.
The court then directed the country to clarify whether the rules had been amended to appoint a retired court judge as the head of the commission.
For this, advocate-general R Shanmugasundam proposes that the appointment has been made according to the direction of the division bench in court.
Record the same, the court directed AG to produce a copy of the assessment on January 31.
The problem is related to batch applications that challenge the validity of certain provisions of the POLICE NADU NADU (REFORMS) ACT, 2013.
The applicant also wants the court to direct the state government to form an independent police complaint committee as directed by the Supreme Court to continue complaints of police brutality and torture .
According to the Petitioner, the APEX court has explained that the committee will consist of independent panel members nominated by the Chairperson of the High Court.
