PANAJI: The Bombay High Court in Goa has canceled the first information report (FIR) registered against Tiadrist and 22-year-old singer Alison de Curorim based on Coppolim complaints MLA Clafasio Dias.
The legislator accused that the singer hurt religious sentiment in the song ‘Dongi Mla’, uploaded on social media.
The court stated that the accusation “did not insult or try to insult the religion or religious beliefs of Christians as suspicion.
In fact, there was no statement that was even related to Christianity or trust of Christianity.
The accusation, the highest, can be related to respondents No.3 (CLAFASIO DIAS) Allegedly conducted several activities or did some actions contrary to their religious beliefs “.
The division bench consisting of Judge Sunil P Deshmukh and Mahesh Sonak also found “Nothing on the allegations and even very suggestive of the intent of religious feelings of any Indian class.” It added that “the alleged anger of the feeling of respondents No.3 or alleged insults or efforts to insult him is not the same as the anger of the feelings of Christianity in general or insult or try to insult Christianity or Christianity’s beliefs, especially,” the court was held.
The police authorities “surpass their jurisdiction in registering FIR under Section 295 – A from the IPC,” said the court.
Kaif Noorani’s advice that represents the Dias Clafasio submitted to court that the investigation is in a newborn stage and that as long as FIR revealed the commission of a recognizable violation, the court must allow investigation institutions to investigate the allegations.
The court clarified that the termination of FIR would not affect the rights of the DIAS to take the right process in the context of its accusations involving violations that could be punished under the part 500 IPC.
Counsel Ryan Menezes, representing Alison, police hat submitted continued to register firmly against it just because the Dias was MLA.
