Chandigarh: The Punjab High Court and Haryana have explained that non-teaching employees who serve in private universities assisted by the Haryana government will not be entitled to the benefits of the Ex-Gratia scheme for the provision of aid who died to the family.
HC also added that non-teaching staff from universities assisted were not borne even under the concept of ‘parity in work.’ “Actually the universities assisted by the government are owned and managed by private management but get assistance from the government.
This is a position, staff of the universities assisted by the government are not government employees and hence, they cannot be a problem with the claim of the rights of the scheme,” HC held .
This scheme, called the Rules of Haryana Civil (Financial Assistance or Appointment of Week Asih), 2019, came into force since August 1, 2019 ..
Haryana can extend the rules to the assisted PVT colleges: HCT aim for the scheme provides loving financial assistance or.
The appointment to the family of every government employee who died or disappeared during service, consequently, to alleviate the family of employees relating to financial difficulties.
“After going through these rules, it is clear that they only apply to families of government employees who while working regularly die during service.
It is on the right of the state government to extend the rules above 2019 to employees of private universities assisted by the government,” observing HC in a detailed order released on Wednesday.
The Division bench consisting of Judge Rajan Gupta and Justice Karamjit Singh passed this order while rejecting the appeal submitted by Swadis Haryana universities who did not teach employees who had searched for HC intervention to expand the benefits of the EXGRATIA scheme for the provision of family assistance from dead employees In private universities assisted by the government in Haryana.
‘Looking for parity with government employees, the Petitioners argue that since the university employees who are assisted by the government are also employees of the government Haryana in accordance with the provisions of Article 12 of the Constitution and 95% of the assistance is also provided by the state government to these institutions and them entitled to the same benefits given to employees who work in government universities, especially in the circumstances in which all government control – the college is with the government Haryana such as recruitment, registration, paying the empblo yment scale, service conditions, pensions, etc.
The appeal was submitted by the Association of the orders on February 2, 2021, passed by one HC bench disbanding their application.

However, the division bench has refused the request to observe no services in the appeal.
