Gandhinagar: Adopting the Government of Indian 2021 Indian Model Tenancy Action, the Gujarat government plans to introduce a new Tenancy Law for the State to replace Bombay rent (now Gujarat), House Rates Control Law House, 1947.
Although new actions will be structured to ensure impartiality for Property owners and tenants, new laws are expected to protect property owners from unreasonable harassment by tenants.
New law is expected to facilitate the growth of rental properties in the state.
The existing law provided protection to the owner, who was worried about renting out property because they were afraid of harassment by tenants who did not empty the place.
The new law will have provisions to establish state-level authorities to regulate the rental property market.
The source that knows the secret of the development say the state government has decided to replace the rental of Bombay (now Gujarat), the hotel and inn act on house rates, 1947, with new rental actions on the lines of Indian models.
“The state government tends to adopt models without change or minimal during the monsun session coming from the State Assembly,” said the source.
The Tenancy Model Act makes it mandatory for landlords and tenants to sign a written agreement that determines the lease, the period of the lease and other related terms.
The state government will form the body to the Rera (Authority of Real Estate Regulations) to regulate all rental property transactions.
The ACT model recommends that security deposits be limited to two months of rent for housing places and six-month rentals for non-residential premises (commercial and industrial).
New actions will have provisions on the sub-skip property.
