Ahmedabad: Gujarat Real Estate Regulatory Authority (Rera) has imposed a fine of RS 60,000 to the builder because it did not mention the address of the Rera website on the advertising board which was established at the residential project location in Chandkheda.
The project involved in this case was East Ebony on the new CG road in Chandkheda by Hariddh Infra and the promoter was Dharmendrabhai Patel.
Rera issued a notification to the scheme promoter in September asking why he should not be fined because it did not mention the address of the web site in advertising and prospectus.
It is said that must state the address of the Rera portal and the Rera registration number for the project in the advertising material including hoarding.
The promoter’s attention was repeatedly drawn to this hose in stockpiling on various occasions.
Further notification said that by not mentioning the portal in the stockpiling at the project location, the promoter has a prime facie violating the provisions of section 11 (2) of real estate actions (regularization and development).
The promoter was called for an explanation in online hearing and clarified that after receipt of communication from Rera, he has now mentioned the website address in the hoarding.
He also apologized for the hose.
Rera was given 10 days to Patel to submit Affidavit revealed whether there was another hoarding placed on which website was not mentioned.
Patel told the authority that the error was repaired and he would comply with all the guidelines issued by the authorities.
Rera officials examined the newly stockpiling photos and found that laminated paper was affixed to the hoarding where the website was mentioned.
Authority still found a problem with this and said that the guidelines said, “The font size of the Rera registration number and the website address must be taken into account equal to or greater than the contact details of the proposed project.” But the font size in the Patel hoarding is smaller than the contact details.
Rera said that the fines arranged in such hoses up to 5% of the total project costs, namely Rs 50.99 Crore for this scheme.
The authority ordered Patel to deposit RS 60,000 fine from his pocket and directed that the amount should not be withdrawn from the project fund or must be extracted from the buyer.
