HARASSMENT DEPOSION Sexual blindness applies: HC

Chennai: Only because victims of sexual harassment have visual disability, the proof of the culprit cannot be unacceptable, said Madras High Court, giving a seven-year prison to a driver of the Autorickshaw who attacked the woman.
According to prosecution, the automatic driver of Anbu Selvan was employed to transport the victim to his music class.
However, he kidnapped him to a remote location and seduce him sexually besides trying to kill him if he didn’t work together.
Challenging the court order of the court gave his seven-year prison term, Anbu Selvan moved to a high court who said evidence of the victim was unreliable since he was blind.
Justice R Teekka Raman, however, is called Anbu Selvan as a ‘heartless person’ that has utilized helpless situations from people who are visually challenging and sexual harassment.
He has no right to reduce punishment, even for one day, the judge stressed.
Quoting direct and other evidence, the judge said, “Only because of disability, the proof of disabled people cannot be treated as inferior.” The victim version has a vision, he said, confirming the punishment.
Anbu Selvan said, “The identity of the defendant was not proven in a way that was known to the law and since the witness (the victim) was a blind, the proof could not be called an eyewitness if at all, it could be referred to as a witness listener.
Which is not acceptable in the evidence.” Court The trial punished him for a violation under the section 366 (kidnapping a woman), 354 (violence or criminal to women with intention to be angry, 506 (II) (criminal intimidation) IPC and Section 4 (female abuse)) from the prohibition of nadu Tamil women harassment especially based on evidence of victim women.
Rejecting the argument, justice Teekka Raman said, “The victim as a blind person does not have a vision, but his version has a vision and therefore, this court argues that evidence of victims can be accepted in evidence.” The court then recommended the authority of the Tamil Nadu state legal service to provide Rs 1 Lakh as compensation to the victim under the COMPENSATION scheme of Tamil Nadu victims.
