Mumbai: The Bombay High Court on Wednesday questioned the Nawab Malik State Minister if he had verified documents against NCB officers Sameer Wankhede and his family before uploading him to social media.
“Have you verified as a responsible citizen and as a spokesman for a national political party?” Justice asked Madhav Jamdar, directed Malik to submit a written statement stating that.
The judge heard the defamation settings submitted by Dhyandev Wankhede (72), Sameer Wankhede’s father, against Malik.
Justice Jamdar also directed Wankhede to show “that tweet or material that was literated with his complaint, which was tweeted by the defendant (Malik), wrong.” Advocates Wankhede Arshad Shaikh argues to benefit Malik from making further comments.
He refers to Malik’s reply that if the birth certificate of Sameer Wankhede shows that he is a wrong Muslim, he must provide the correct certificate.
“Why should I justify my studies to an individual who might be MLA but not a court or quasiijamian authority?” He asked.
He said Wankhede tried to protect blood and his family.
“When you say you want to expose the Sameer Wankhede, why (have) you attack his father?” Shaikh asked.
But Justice Jamdar said he had to concentrate on the aspect that Malik’s tweet was wrong.
“Forget about technical.
You have to show the prime facie tweet it’s wrong.
Putramu is a public servant.
His actions can be examined by any public members,” he added.
Senior Advocate Atul Damle, for Malik, said Wankhede has received an upload coming from a family social media account.
“He accepted this uploaded by Son and Princess on Instagram, Facebook …
Where the question created a document wrongly? I haven’t posted in the air,” Damle said, adding whether the document is correct or wrong can be seen during the trial.
Justice Jamdar pointed towards “Samir” appeared on the birth certificate.
Damle said it was issued by BMC.
That’s when HC asked, “Is it not your job to verify?” Asked whether Malik’s reply had a statement about verification, Damle said there was no special statement except that the acceptance and authenticity of evidence could be decided at the trial stage.
“Reception is (a) different aspects.
Is it authentic, it is your responsibility.
You must submit a reply and verify the truth,” Justice Jamdar said.
The judge said he would only hear about Ad-Interim’s help for orders on Friday.
When Damle said the assistance was also sought for members of the Malik Party and all who acted on his instructions, Judge Jamdar said, “I will not accept the command.
He also (a) Indian citizens and are looking for damage.
Even if it is his son, finally him also slander, “said HC.
