HC allows 17-year victims of rape to cancel pregnancy

Nagpur: Come to save a class XII student, who was allegedly raped by his mother’s Paramour, the Nagpur bench of the Bombay High Court on Monday allowed him to stop his pregnancy 19 weeks.
The division bench consisting of Judge Vinay Deshpande and Amit Borkar directed the Dean of Indira Gandhi Government Medical College and Hospital (IGGMCH) to immediately complete the formality and take the steps needed for DNA profiles and preserve samples, including the fetus.
The bench also instructed the investment officer of the Khaparkheda police station to immediately seize, seal and forward samples to urgent chemical analyzes.
“Survivors became pregnant because of sexual attacks by the defendant.
The petition was submitted for the cessation of forced pregnancy at the minor.
Pregnancy can be stopped immediately because the applicant has become an Indoor Patient IGGMCH,” the judges said.
The 17-year-old girl, through Fair Mirza’s advice, has knocked on the doors of justice, accusing the pregnancy forced on it by Audkus Anilkumar Shrivastava, who allegedly exploited him with the help of his mother and relatively far away from Shambhunath Pal.
He also experienced mental and physical harassment by the trio accused after his father’s death a few years ago.
While praying to allow him to cancel the earliest fetus, Mirza told the court about deteriorating health.
Previously, the medical council consisted of gynecologist, a female doctor, and an anesthetic expert, examined minors and submitted a report to HC through the demands of the additional public prosecutor Sanjay Doifode.
The Board stated that medical cessation of pregnancy (MTP) was decent medically according to the Action of MTP.
The patient has been fully investigated until now and is suitable for MTP from anesthesia and the point of view of the doctor with the risk of maturity, the members said.
On the basis of his complaint, Khaparkheda police ordered three accused under Section 376 (2) (N), 323, 506 IPC and Section 5 (I), 6 and 17 of the protection of children from sexual violations (Pocso) acted.
Two defendants were arrested while Shrivastava’s main accusation escaped.
