HC CBI orders to investigate cases of violence after the Bengal poll

Kolkata: The Calcutta High Court on Thursday ordered the CBI probe “monitored by the court” into the murder case, rape and tried rape during the poll in West Bengal and established a special investigation team under the supervision of the Supreme Court judge to retire.

The five judges, led by the chairman of the acting Judge Rajesh Bindal, also directed NHRC, the state and commission or other committees who received complaints to submit all records relating to the murder and crime cases against the CBI.
But all cases not related to violence polls must be handed back to the local police, the court said, adding that “every obstruction to be investigated will be taken seriously”.
Three bench members – Mukerji IP Judges, Harish Tandon and Sousumen Sen – provide “judgment forever” separately.
The court refused to determine a certain period for “post-polling violence” but covered all complaints conducted during the entire selection process, starting from the first day of voting (March 27).
“If there is a violation done before the declaration of the results and has a connection with the selection process, it can also be considered as part of the violence after the poll,” Bench said.
The state government is considering appealing to judgment in the Supreme Court “at some certain points”, Sanjay Basu, an advocate for the Bengal government, said.
“Many aspects (from the assessment) justify our holder,” he said.
CJ acting, in the main assessment, recorded NHRC reports, the “exception” petition of the state government to the NHRC report, the procedure adopted by the NHRC and commented on the accusation of “bias” to the responsibilities of the NHRC and EC.
HC also recorded contradictions between NHRC and state government.
NHRC reported 13 rape cases, including two rape gangs where the complainant moved SC; The state government reports cases of rape-to-rape.
NHRC reported 59 murders; The state government admitted 29.
The bench also noted that the police “closed” some cases after starting the firs Suo Motu.
The judges discussed separately on charges of bias against three NHRC members because of their affiliates of political parties.
“The accusation of the committee is not material because this court considers not only the report but other materials, including advisory arguments,” said the Mukerji court in his assessment.
However, in some controversial NHRC observations, he observed that the NHRC panel “did not have jurisdiction to make recommendations or express any opinion”.
He said, “We don’t vest with that power.”
