Prasagraj: The High Court of Allahabad has refused a guarantee to a man accused of raping a woman after promising to marry her and, after that, allegedly pressing it to change her religion as a condition for marriage.
Rejecting the application guarantee Farhan Ahmad, aka Sanu, from Gorakhpur, Judiciary Om Prakash Tripathi, “Given the fact and circumstances of the case, a rivalry conflict from the learning advisor to the parties and the accused and serious consideration of rape allegations of the applicant, at this stage, without commenting on services this case, I do not consider it suitable for guarantees.
“The applicant was imprisoned for violations below Section 376 (rape), 504 (insulting with the intention to provoke peace violations) and 506 (criminal intimidation) IPC, besides section 3 and 5 (1) from Uttar Pradesh Prohibition of Conversion Conversion of the Law of Religion, 2020.
FIR was submitted against it at Ramgarh Tal Police Station of Gorakhpur.
The complainant alleged that the defendant persuaded him to be a physical relationship with a false promise of marriage.
“He then pressed me to enter Islam, threatening him won’t marry me unless I entered,” he said.
The woman also accused her that she was afraid of her life.
During hearing, advisors for the Petitioner argue that the latter was wrongly involved and that the relationship was consensual since the applicant and complainant were adults.
He cited the medical report of the woman, which said there was no external or internal injury in his body.
The applicant also did not pressure the complainant at any time to convert to Islam, the adviser said the advocate that emerged for the state government submitted sexual relations with victims with the pretext of false marriage must be treated as rape.
