HC designates Justice Haq to investigate regularization of PU land by NMC, NIT

Nagpur: The day after condemning citizen bodies to regulate the plot of public utilities illegally, which are leased to the private sector or encroachment, the Nagpur bench of the Bombay High Court on Thursday was appointed by Justice (retirees) of Zaka Haq to ask all of these cases.
The division bench consisting of Judge Sunil Shukre and Anil Kiors asked retired judges to investigate all PU land, such as playgrounds, open spaces, and parks, spent or rented and then registered on behalf of the private sector.
He was directed to resolve investigations within six months and submitted a detailed report on violations, the advisor to the Petitioner M Anil Kumar.
The judges have fixed RS50,000 as a remuneration for the judge to start.
Nagpur Municipal Corporation (NMC) and Nagpur Repair Officials (NIT) were told to fully cooperate with the request panel.
Judge Haq was also told to ask about the opposition of the Petitioner – Jagjitsingh Saddal and others – that they were stopped from building something in their plot because it was provided for the playground and primary school by NIT.
The applicant claims NIT has auctioned a playground and open space provided for schools in Indora in 1987, and NMC has allowed plot buyers to build houses under the Aegis Society of Indora Housing.
After the applicant was banned from construction, they approached the judicial door in 2007.
On Wednesday, the judges direct the head of the NMC and the head of NIT to personally pay attention to this case and ensure that the entire record and process of ordering the applicant’s plot is delivered, and every failure will be taken seriously.
Citing the order of July 7, 2018, the judge observed that since 1987, instead of limiting the layout and illegal development, with the guise of policy decisions, layout and encroachment being legalized at the cost of the general public by civilian bodies.
