Madurai: Observing that there is no need to submit an anticipatory guarantee petition because the court court only issued a call, Madras High Court on Monday rejected the anticipatory assurance applicant from the former BJP National Secretary and others in a case registered by the Polukkottai District Police to pass the demeaning comment On the judiciary in 2018.
The court also directed them to appear before the Judge Judicial Court of Thirumayam on July 23 to be tried.
The court heard the guarantee petition submitted by the King and V Suryanaranyanan which is the news editor of the South Union RSS.
Justice G Chandraskharan observed that the accusation made to the applicant was that he made comment insulting towards the High Court and also the police.
The judge observed that the accusation of the applicant and other defendants was the problem of trial and the high court at this stage could not enter this case service.
Noted the fact that the trial court only issued a call for the appearance of the applicant, the judge observed that the court argued that there was no necessity to submit this petition seek anticipatory guarantee.
Therefore, the judge rejected the petition and directed the applicant to appear before the Judge Judicial Court of Thirumayam on July 23 to face the trial.
The prosecution case was that the applicant and other people by violating the court order continued to form a stage for the meeting as part of the Chaturthi Vinayagar celebration in the Pudukkottai District on September 15, 2018.
When police officials tried to stop them, the king took the argument where he passed down the condescending comments about justice.
After this incident, Police Thirumayam enrolled a case against the applicant and others.
After completing the investigation, the police submitted a final report caused by Judge Judicial Court Thirumayam.
The applicant said that they did not commit violations as alleged by prosecution and their reputation would be affected if they were arrested.
Government advocacy against anticipatory guarantee grants to applicants and intervention petitions was also submitted against the provision of anticipatory guarantees to the applicant.
It can be remembered that after the king made a comment insulting about the judiciary, the process of insulting Suo Motu began on him in the court seat in Chennai.
After the king apologized to the High Court, the insulting process was closed.
