HC directs NMC to take action against stores in Hawker Zone

Nagpur: Nagpur bench Bombay High Court has directed Nagpur Municipal Corporation (NMC) to start actions against the conversion of the snack zone to shops and non-hygienic conditions caused by shop owners in Jaripatka.
Irked with a lack of actions from the civil body and serious discomfort caused by a foul odor, encroachment on the road, Nitin Lalwani’s advocate and five residents of Jaripatka have filed a petition in HC through the Advocate of Shyam Dewani.
In the order passed on September 2, Judge Sunil Shukre and the Anil Kior said, “We asked Commissioner, NMC to establish a team of officers responsible with the direction to them to visit and examine the area in connection with this petition had been submitted and took immediate action against vendors / Shop owners who will be found violate the law and guidelines as stated earlier and submitted their reports to this court on the next date.
“The Judge said that if there was a police assistance, the same was provided by the Police Commissioner.
“We also asked the Commissioner to stay present before this court personally or through several responsible officers screaming for providing effective assistance in this matter,” they said while postponing the trial on September 15.
The applicant mentioned that the Hawker zone was located behind the bus standing on the finger.
They stated that the area was fully under the clutches of shop owners, the owner of poultry / shops and deduction houses that made the permanent structure violating the norms of the hawkers zone.
Judges refers to the Supreme Court guidelines stating that the vendors must do business in the 1×1 meter area on one side of the trail wherever they are or are on the extreme side of the carriage, such that vehicle traffic and pedestrians are not hampered and access to shops and residences are not blocked.
According to the guidelines, poultry farms are engaged in changing, slaughter, and packing considered under the Red category and therefore the unit is required to be at the appropriate distance from the residence of humans and water bodies to avoid pollution and infection.
The right setting for cleaning and maintaining cleanliness in these places every day is needed to be made by the owner.
