MUMBAI: Questioning who’d take responsibility if pupils got affected because of Covid-19, Bombay high court on Thursday failed to intervene with the state administration’s determination to cancel SSC examinations, saying that it had been a policy issue.
“These are matters of coverage.
The executive has accepted a choice.
It might seem to me and you as absurd…Can there be a floor to intervene?” Requested a seat of Chief Justice Dipankar Datta and Justice Girish Kulkarni.
The judges said that they would just interfere”when the coverage choice manifests arbitrariness or it’s determined by the right of someone bound by the choice.” The court found a request by Dhananjay Kulkarni, a retired instructor from Pune, that had contested the country’s May 12 determination to cancel the examinations for 16 lakh pupils and also for outcomes based on inner assessment/tests, stating it might result in issues including Class XI admissions.
At the start, the CJ asked,”When the examinations are held along with the student community becomes influenced, who’ll be liable?” The judges remarked that the pandemic scenario is far more grave this season and just about all nations had cancelled examinations.

Advocate-general Ashutosh Kumbhakoni claimed the CET was released to deal with the dilemma of bringing pupils of the 3 boards on a single stage.
He explained the CET has been held for meritorious pupils and there were pupils who wanted to enter schools of their choice.
The AG explained the CET was discretionary and students could choose the test no matter the board.
“If most of boards are permitted to take part in the CET, what’s the arbitrariness in this?” The CJ requested.
The judges dismissed the request as pulled after Warunjikar stated his client didn’t want to move with it because his prayer against rescue of examinations were cared for by CET for many flows.
