New Delhi: The Delhi High Court has asked the Director of the Enforcement Directorate to explain how the reason for the arrest was informed to the person arrested in the investigation carried out by him.
The high court order came when he heard the request submitted by the Directorate of Enforcement that challenged the court’s court order directing it to supply a copy of the Ecir case information report (ECIR) to RJD Rajya Sabha MP Amarendra Dhari Singh, arrested in the case of relevant money laundering for alleged fertilizer fraud.
Justice Mukta Gupta issued a notice and asked Singh to respond to the defense by Ed who wanted to override the order on July 15, court.
“Meanwhile, a written statement from the Director, the Directorate of Enforcement will be submitted on records that show the status of the ECIR in the investigation conducted by the Applicant (ED) and whether the same is only a number or record some substantive information in the applicant to start the investigation on it before submitting a complaint case , “said the judge.
HC said that the written statement will also show everyone arrested how the reason for the arrest was informed to the person who was arrested in terms of guidelines issued by the Supreme Court.
Additional Lawyers General V V Raju, representing the Directorate of Terms, argued that there was no special power with a special judge court trial under the CRPC to deliver direction instructions to supply copies of the ECIR.
