HC is looking for data about illegal buildings in 150 GHMC wards

Hyderabad: The Judge of the Telangana High Court has referred to the problem of illegal structures to the division bench that urged him to get data about the building was collected from all 30 GHMC circles covering 150 wards in larger Hyderabad.
Justice Challa Kodaram, who has listened to the petition relating to illegal buildings, said illegal structural owners and illegal builders abuse the temporary commandment of the court to complete construction without obstacles.
Judge Kodaram on Wednesday referred to such things that came to his notification to the high court registry with the direction to place them before the chairman of the judge who rose hearing the problem.
He also found an error with a civil court to provide a status quo even after the division bench from the previous high court asked them to be careful when dealing with illegal structures.
Said that a number of civil suit being submitted in the Hyderabad civil court with the main purpose of making them dismissed, the judge said a closer look at the statistics equipped with GHMC had shown that the owner of the illegal structure that approached the civil court against the dismantling notice of demolition never really cared about the final result of the case.
“They are only interested in getting temporary commands and completing construction.
After construction is done, their owners and lawyers stop attending the hearing of the court and invite dismissal orders by default in appearance.
Orders of dismissal are everything they need after their destination is presented,” said the judge.
He said the GHMC or the City Administration Department was found on the wrong side because the record showed no earnest effort to empty command orders.
“This case will now leave before CJ,” he said, hearing the case of insult filed by R Narendra Babu.
The judge himself got a sample check done at Amberpet GHMC circles where 189 illegal structures had been built.
Examples of checks Throw statistics surprise illegal structures and smart methods used by builders to complete construction.
“They use a court to achieve their goals.
Every time they receive dismantling notices from GHMC, the owner or builder approaches the civil court that urges him to hold the GHMC from disturbing their properties.
If the court asks officials and owners to maintain the status quo, that means Both parties must stop their work.
But in Hyderabad, the status quo is read as living in GHMC alone.
The owner uses the same command that holds them to resolve their illegal structure, “said the judge.
GHMC officials and ground staff are also more than willing to read court orders this way even though the real imports of the court order may not be exactly the same, he said.
“Several times, mere notification from the civil court is enough for them to stay away from their duties,” he said.
“It is better for them to be heard by the division bench to arrive with a comprehensive solution,” said the judge.
