Lucknow: Lucknow bench from the High Court of Allahabad has refused to allow the police to foster beards and resist the rejection to cut the beard even though given direction in this case by high-ranking officials were a violation issued on October 26, 2020 by the Director General of Police.
“Therefore, it is not just the wrong behavior but the same is a mild violation, mistakes and copbility of the police,” the court observed.
Judicial bench Rajesh Singh Chauhan passed the order on the writing petition submitted by police Mohammad Farman.
Observing that the growth of a beard by members of the discipline power may not be protected under Article 25 of the Indian Constitution, the bench is held, “This is a competent authority domain to issue guidelines regarding the right uniform and maintain the appearance of the way needed for members of the discipline and no Disorders that must be done, as far as, maintaining and wearing appropriate uniforms and maintaining physical appearance is one of the first and most important requirements of disciplining members.
“The applicant has challenged his suspension on November 5, 2020 and the Chargesheet issued on July 29, 2021.
The senior police supervisor, Ayodhya, had taken action against him because he maintained a beard despite being given instructions to shave it after October 26, 2020 which forbade a police officer in the police to keep the beard.
Darkened to deny the request that maintains a beard is the fundamental rights of the applicant, the bench observed, “Article 25 of the Indian Constitution does not provide absolute rights in this matter.
All rights must be seen in the context and letters and spirits where they have been framed below the Constitution.
Rights Guaranteed Based on Article 25 of the Indian Constitution have innate limitations.
“Destroying the petition on August 12, 2021, benches direct authorities to conduct and conclude the department’s investigation against the applicant in accordance with the law.
