PANAJI: The Bombay High Court in Goa has issued a notification to the government for the petition that challenges the separation of the list of electricity departments into two for the engineer assistant diploma.
The petition submitted by the Assistant Engineers (Electrical) Association has stated that this contrary to the seniority rules of Goa Government, 1976, and service regulations and contrary to recruitment rules for assistant cadres engineers.
The petition came before the chairman of Judge Datta and Justice Mahesh Sonak, recently.
The applicant is permitted to make other officers, which may be affected, siding in the petition.
According to the association, the list of seniority cannot be changed to separate Diploma and Degree holders unless recruitment rules are changed.
The applicant said that there was no other government government department, such as the Department of Public Works or Water Resources Department, has a list of separate seniority for cadres of assistant engineers based on educational qualifications.
“The separation of the list between Diplomans and Holders will result in seniority disorders between cadres and influence the hierarchy of the reporting and assignment of established roles,” said the association.
“Two lists will create a sense of confusion for freezing responsibilities based on seniority and result in conflict between cadres,” the association was submitted to the High Court.
The association stated that he had a problem with government notice in vain.
The respondents included the Secretary of the Chief, the strength of the main secretary, the Law of the Primary Secretary, the Main Secretary Personnel, Chair of the Electric Engineer and 102 AES.
Assistant engineers in the electricity department from the beginning have a list of general seniority.
In June 2018, the list of tentative seniority was issued with a list of separate seniority proposed for holders of degree and diplomas.
In August 2019, the Applicant objected with a list of tentative seniority.
The applicant was called for personal hearing on August 7, 2020, and on November 23, 2020, the main secretary received recommendations by the Department of Personnel to maintain a list of separate seniority.
On November 24, the minister’s chairman agreed to the recommendation of the personnel department after the applicant issued a legal notice on December 17, 2020, requested that the seniority list withdrawn.
