HC notification to the center, the state of the upper application against Lab Path Technician

Nagpur: The Indian Medical Association (IMA) has moved the Nagpur bench from the Bombay High Court to challenge the feasibility of technicians to run the pathology laboratory, and sign a test report certificate.
Those who hold a Bachelor of Medical Laboratory Technology (BMLT) and Diploma in Medical Laboratory Technology (DMLT) usually run the company.
Before postponing hearing up to four weeks, the division bench consisting of Judge Sunil Shukre and Anil Kior issued a notification to respondents, including the central and state government.
Petitioner’s adviser Bhanudas Kulkarni believes that the Maharashtra government through its resolution on May 24, 2016, has forbid people who hold DMLT from carrying out the pathology laboratory and warning penals.

Quoting the verdict from the Supreme Court and the High Court of Madhya Pradesh and Gujarat, the applicant said Lab technicians who did not hold pathological qualifications could not run any independently laboratory.
According to the Petitioner, the BMLT and DMLT holders cannot provide direct reports to each patient, individual or doctor without authentication from a pathologist registered with the Indian Medical Council (MCI).
