Chennai: The High Court of Madras on Friday published a notification to the central and state governments on the application of Nalini Sri Hararan, one of the seven convicts in the murder case of Rajiv Gandhi, looking for directions for their release all without waiting for the nodding Governor of Tamil Nadu.
Nalini and six others – Murugan, Santhan, Perarival, Jayakumar, Ravichandran and Robert Payas – serve the life in the murder of the former Prime Minister, during the poll nearby in May 1991.

With a resolution on September 9, 2018, the Cabinet AIDMK LED Kabin K Palaniswami has recommended to Governor of Banwarilal Purohit to consider and order for the release of all inmates.
When the governor did not make a decision, Nalini and the other had submitted several Writ and Habeas Corpus petitions for his direction to consider their requests and ordered their release.
But the High Court refused to issue a direction to the governor.
In his current petition, Nalini tries to declare as not constitutional, the actions of the governor and failure to heed the country’s recommendations.
He prayed for a consequential direction to the state government to release his own inmates without waiting for the Governor’s approval.
The recommendation of the state government binds the governor and he does not have the other unless order for their release.
He did not have any wisdom but to act according to the cabinet recommendations, he argued.
Overall, around 3,800 inmates of life, which have served 10 years in prison or less, were released based on article 161 constitution, he showed.
