Vadodara: The Gujarat High Court on Thursday canceled the prevention of the Anti-Social Act (PASA) command against a man accused of selling remedy remedies illegally in the city.
The city police have detained Kronal Patel under Pasa on July 1 after he received a guarantee in the violation registered with him.
Patel was arrested by the prevention of Crime Branch (PCB) on April 11 after they damaged the allegations of illegally rembesivir sales racts at higher prices.
Patel, who worked as a male nurse in a private hospital, was accused of selling rempasses to two other keys accused when the drug was in high demand during the second wave of Covid.
“Patel was given a guarantee by the Gujarat High Court on June 25 and he was released from the trial detention on June 30.
But the police immediately detained him under the petition.
I have submitted a petition in the High Court and challenges Pasa Order,” said Advocate Anant Christian who represents Patel.
“The police called him drugs but remdesivir was not included in the NDPS law.
Also, there was no other violation registered against Patel and he did not have a criminal history.
There is no reason to beg for Pasa against Patel after only one fir,” Christian added.
The court observed that the detention authority fell on an error in treating applicant’s activities as prejudice for maintenance of public order.
The court also said that the detention authorities had noted that the applicant’s activities create alarm taste and feelings of insecure in the minds of society in general.
‘However, vis-à-vis material on the record, this court found that the quotes of words like that were more in ritual properties than with the significance of the alleged applicant’s activities,’ the court observed.
