Kolkata: Calcutta High Court on Thursday rejected BJP’s prayer that seeks the spread of central forces in Kolkata Civic’s poll scheduled on Sunday.
Judge Hakim Judge Rajasekhar Mantha went with the submission of the State Election Commission (SEC) and was trusted by the Advocate General, who convinced free and fair electoral courts.
“Because the SEC does not see the terms of the central strength, this court does not tend to cause prayer,” said Judge Mantatha.
The applicant has moved the division bench from the Chief Judge Prakash Shrivastava, challenging orders.
The division bench will hear this problem on Friday, two days before the poll.
Justice Manha remembers the previous order by the Calcutta High Court Division bench, where the bench argues that “the spread of central forces in the city selection must be on the Sec” Decree.
The Court, then, refers to the SEC view of security arrangements for polls.
“The view expressed by SEC is clear and explicit,” he said, added, “There is no need for central forces in elections to KMC to be held on Sunday.” The Petitioner’s advice argued that the Supreme Court called on central forces in the recent Civic poll in Tripura.
For this reason, justice Manha observed that the situation where the Supreme Court had passed the direction “not available here”.
The judge noted the report submitted by the Single Judge SEC did not cause the Petitioner’s complaint that the State failed to fend off a sustainable threat to the applicant.
The court argued that the police commissioner had taken steps.
“Communication from the Commissioners shows that a police officer, armed with it should be given by each of the four applicants,” the court observed.
Justice Mantha also directs the police commissioner to pay attention to other complaints and take the right steps based on the perception of threats.
“All steps must be taken to facilitate the implementation of franchises by citizens and ensure that free, fair and peaceful elections are held,” the court observed.
