Kolkata: The Calcutta High Court on Wednesday refused to pay attention to the BJP tree to remain a Kolkata Civic poll scheduled for December 19.
Bench Division of Prakash Chair Shrivastava and Justice Rajarshi Bharadwaj quoted the BJP Law but directed the State Government and the State Election Commission to present “without further delay” the minimum number of phases needed to complete the polling process for other civilians.
State SEC can do a poll to the city left in two phases with the number of evams he has, the bench was observed, when the state submitted his plan to conduct a poll in six to eight phases in May 2022.
The court will listen to this case again on December 23.
“We hope for respondents (state government and sec) decided to remember the responsibility to enforce the principles of democracy and carry out the constitutional mandate,” the court was observed.
The Division bench also clarified that the Volular Verified Paper Audit Line (VVPats) would not be mandatory in the poll for the local body when handling the BJP Petition Pratap Banerjee petitioner.
Senior Advisor Pinky Anand has quoted the Supreme Court’s decision on the use of mandatory VVPats but the bench said the Supreme Court’s decision was in the context of parliamentary and assembly elections.
The court, however, wanted seconds to see if the number of VVPats could increase fairly in the KMC poll.
“Good Satisfaction Seconds and Systems in modes are doubtful by the court.
