Kolkata: The Calcutta High Court has refused to hear the urgent basis, challenging pills “constitutional exigue” to hold Bhowanipore Bypoll assembly based on the Letter of Secretary Election (EC).
The court will hear it on September 20.
The division bench from the chairman of the judge Rajesh Bindesh and justice was rajarwaj on Monday called on the Bikash Bhattacharya Petitioner’s advisor why he moved a few days after administration of EC in September 4.
Bhattacharya submitted that the pill was submitted on September 5 5.
Advocate General Kishore Dutta said that the election process It’s been going on and there is no court that can interfere with it.
He showed that holding the election was the only prerogative of EC.
“The main secretary wrote to the EC to avoid emptiness in the state,” he said.
Bhattacharya fought the claim, said that there was no “constitutional exigue” besides “personal exigence” to hold the Bypoll.
Petitioner Sayan Banerjee challenged “priority” to hold the Bypoll in the middle of a pandemic and complain that it was caused by an un elected minister.
Banerjee pointed to the EC logic holding Bhowanipore Bypoll.
“While the Commission has decided not to hold bintars in 31 assembly constituencies throughout the country, given the constitutional exergy and specific demand from the West Bengal state, it has been decided to hold a bye selection in Bhowanipore,” Panel polls have said.
