Bengaluru: Relief for Karnataka Minister CN Ashwath Narayan and Yogeshwara CP and SR Vishwanath legislators and Srinivasa Gowda, the High Court in the country has set aside a portion of the sequence of special trials that are exclusively related to criminal cases related to selected representatives in the case of Lotus Operations 2019.
Judge Sunil Dutt Yadav said, in the order last week, that special judges had to follow the procedure in the prevention of the Corruption Court and asked complainant workers and social workers TJ Abraham to get sanctions for the prosecution of parliamentarians before the case could be taken further.
.
On March 29, 2021, the Special Court had ordered the registration of criminal cases against these leaders under the prevention of Indian Corruption and Criminal Codes, in addition to publishing calls to them.
Special courts have said that since the Governor of Karnataka did not respond to complainant applications that seek sanctions for the prosecution of legislators for three months, must be “interpreted that there was approval for their prosecution”.
This quoted the Supreme Court ruling in the case of Subramanian Swamy vs Manmohan Singh.
Challenging orders, the applicant debated before the High Court had no sanctions from the governor to continue to them and seek the accomplished process that began against them.
In his complaint, Abraham has stated that on February 10, 2019, Kolar JD (s) MLA K Srinivasa Gowda told reporters that Vishwanath BJP, Ashwath Narayan and Yogeshwara offer it Rs 30 Crore to switch as part of the Lotus operation to seize the Leadus offer to form a government in the state.
Gowda claims he was offered a minister’s bed in the BJP government.
According to Abraham, Gowda alleged that BJP leaders defendant gave him Rs 5 Crore in advance which he kept for two months.
After a press conference, Abraham went to Kolar and asked a question revealed that JD was trying to defend Gowda in his fold.
Abraham’s petition said Gowda stated helplessness to the Head of HD Kumaraswamy JD that he had spent RS 5 Crore and said he had to return the number to BJP leaders before rejecting their party’s offerings.
