Nagpur: In a big assistance for tribal students who are looking for acceptance in the postgraduate engineering courses, the Nagpur Bench High Court Bombay has given them temporary assistance by directing respondents, including the Ministry of Union Education, to accept forms of acceptance on the basis of caste / tribal validity certificates issued by the country panel to enter the chair provided for the scheduled tribe (ST).
The division bench consisting of Judge Sunil Shukre and Anil Kiors directed respondents to process students according to the services and in accordance with the law until the order further.
“In a situation, we find that the case of the Prima Facie has been made by the applicant.
Thus, we tend to provide limited interim assistance.
On the next date, this petition will be taken for the final disposal.
Therefore, parties impose notifications to complete the application They are in advance.
We also explain further that no more time will be given in this matter, “said the bench.
The direction came while hearing the request by the Tribal official forum through Counsel Mohan Sudame, praying for temporary assistance to tribal students.
The applicant has challenged centralized counseling rules for MTECH / March / MPLAN receipts, where it was made mandatory for ST students to submit a case certificate of caste / tribes issued by the Indian government in its own format, which is available on its website.
Sudame argues that the format of the Indian government is different from the certificate issued by the caste / tribal examination committee, which is formed in accordance with the laws of Maharashtra to publish and verify caste certificates.
He prayed to allow ST students to take part in the acceptance process on the strength of the caste / tribal validity certificate issued by the supervisory committees formed based on state laws.
