Chandigarh: The Punjab High Court and Haryana on Tuesday has a decision of the Punjab government to cancel the permission of the Orbit Aviation Pvt Limited Bus, a company owned by the former Minister of Punjab Minister Prakash Singh Badal.
HC has also ordered the state to immediately release the company bus confiscated by the authorities.
The division bench consisting of justice Ajay Tewari and Justice Pankaj Jain has passed this order, hearing the petition submitted by Orbit Aviation Private Limited.
In his application before HC, the company through his advice, senior advocate of Balinese Puneet and Advocate Surjeet Bhadu, argued that the command of October 11, 2021, the competent authority has allowed the applicant to make government contributions RS 77,15,061 in four monthly installments Rs 19.28,765.
Advice said on November 15, 2021, the entire tax was paid by the applicant, who was waiting until November 30, 2021.
However, before that on November 12, 2021, the Petitioner’s permission was canceled.
Appearing for the Punjab government, Advocate General (AG) DS Patwalia said at first, after order on October 18, 2021, the applicant did not make a penny payment or he appealed the order and only after that the state authority was limited to canceling permissions.
It was stated that the applicant’s company made a payment afterwards and therefore, his bonnya fides were suspected.
AG said there was no provision in actions or schemes for revocation of permission cancellation.
“Even though this court in the implementation of his extraordinary jurisdiction can do it, that power can only be served if the petition is finally heard and allowed if at all,” Agung.
After hearing this, the bench observed that once the applicant was allowed to make a payment with installments, because it attracted the order, in our opinion that we considered, the notification must be issued.
“Since now the tax has been paid until November 30, we consider it according to directing the state authority to release the bus into and to allow applicants to their provisions.
Explain that the continuation of this order will depend on the argument that will be heard, after the application is complete,” observe HC.
The problem has been postponed for November 29 for further hearing.
