HC still holds a test for the appointment of the principal

Patna: The Patna High Court on Tuesday continues to hold a test for the appointment of the principal in the national elementary school in the state until further orders.
The rules formed for the appointment and conditions of their services have been challenged because of the mandatory conditions of the eight-year regular service experience for qualifications and alleged ambiguity in the English and Hindi versions.
National Principal Principal Bihar (appointment, transfer, disciplinary action and service conditions), 2021, was formed in August this year.
Overall, the manufacture of 40,158 post-school principals in elementary school is standardized by the State Cabinet on September 7, 2021.
Two separate petitions were submitted in the High Court by Tet-Stet Uttirn Niyojit Shikshak Sangh, which urged Prarambhik Sangh, who urged the court To declare part 6 (v) (a) rules as “Ultra Vires” where the minimum eight years of regular service experience is mandatory for qualifications as principals.
Applicants argue that no such conditions have been included for postgraduate teachers and they will be eligible to promise only by confirming their services.
The applicant also urges the court that clarification is sought in section 6 (iv) of the rules because the English and Hindi versions look different.
“The government must be aimed at the conditions in Section 6 (IV) English version that a candidate must have Tet who qualifies in 2012 or onwards to the appointment as the principal must win,” they said.
In Hindi, the word ‘niyukt’ has been added in section 6 (iv) and according to the applicant, only the teachers appointed in 2012 or onwards with Tet qualifications will be eligible for headmaster posts.
The applicant has urged the court that all TEP teachers are allowed to participate in the selection process to the disposal of the petition.
Appearing for the country, Advocate General Lalit Kishore proposed that ambiguity in the English version and Hindi was caused by typing errors and it would be corrected.
Affidavit the counter on behalf of the state government was submitted, but the Justice Division bench Sanjay Karol and PB Justice PB Bajanthri remained dissatisfied with him.
Mrityunjay Kumar’s advice, Arinjay Kumar, Kumar Shanu and Amrit Kumar appeared for the applicants.
After hearing both parties, the court directed the state government to submit another counter affidavit within four weeks.
Now will hear the petition on December 7.
