Ahmedabad: The Gujarat High Court has directed the elderly pair from Mehsana to go to the US to hand over the custody of their five-year-old granddaughter to their daughter who immigrated illegally and settled there and could not return to India for now.
The woman had gained orders from US courts more than a year ago for temporary prisoners from children sent back to India.
After the US court order, he moved a high court in Gujarat to secure the child’s prisoner.
In February 2021, the High Court had ordered the children’s grandparents to hand over their foster rights to the mother’s grandparents.
The mother insisted on making her son back and asked his lawyer to make sure he was sent to the US.
So, the high court asked with lawyers whether the grandparents could travel to the US.
When the lawyer told them that the elderly pair had received a passport, the High Court on Monday asked them to submit a US visa and asked the embassy to consider their earliest application.
This case involved a couple from the Mehsana District Village.
They immigrated to the US a few years ago without a valid immigration process.
After they have a son, they sent him to India for the right treatment because they faced difficulties in raising him.
A year later, the couple’s relationship was a mess.
The woman obtained child detention rights until August 12, 2021 from the US court but could not return to India to get her son’s prisoner.
In India, the child with his motherly grandparents for almost two years.
When a dispute appeared in the US, the child was taken by his father’s grandparents.
HC ensures that child prisoners remain with Mother’s grandparents.
While insisting that the mother’s grandparents had to bring the child to their daughter, the judges were mentioned that the child would feel comfortable with them and preferably to send him to a foreign country with grandparents, instead of sending him with strangers.
Further hearing about this case is scheduled to last three weeks later.
