Nagpur: After a woman moved the Nagpur bench from the Bombay High Court to complain about the mountain of the Regional Police in investigating her husband’s murder, HC transferred the probe to the State Criminal Investigation Department (CID).
“In our opinion we consider, there should be a fair investigation in this matter.
We have the view that any investigation is done, completely unsatisfactory.
It was not made with the intention of knowing the truth, but it was clear to withdraw the gravity of the actions of the defendant.
Thus , We tend to hand over all cases for fresh investigations for CID, “the division bench consisting of Sonak Judge and Pushpa Ganediwala.
While directing the Mouda police to submit a case paper for Cid, Bench said it was to pay attention to the chronology of events, as seen from the diary and from the satisfaction of the applicant, there must be a fair and impartial investigation into the suspicious death of the deceased.
“The police case diary showed a statement of many witnesses that the defendant went to the deceased’s house with a stick in his quest.
With clear words, they gave a threat to the applicant to kill the deceased.
There was an injury to the body of the dead,” HC said.
After Rajni’s husband’s body, Rajni Wakde was found in the river near their home in Dhanla Village in Moula, he filed a police complaint against the accused – Rajendra and Pranay Rajgire, and Harshad Bawne, accused them of killing him.
However, after Mouda police failed to register a violation of the defendant for the murder under Section 302, he approached the judicial doors through Counsel Firdos Mirza and Akash Moon.
He argued that the police transferred investigations in the wrong direction to beat the tip of justice.
He also blamed them for making a statement and failed to arrest Rajendra the main defendant.
HC noted that the Petitioner’s husband had lost since September 7 and his body was found the next day in a suspicious state.
In addition, vehicles are found in conditions that are substantially damaged.
“There is absolutely nothing in the case of a diary about the investigation of a damaged vehicle.
The applicant pays attention to a few injuries to the body of the husband.
It seems that the investigation officer does not feel the need to investigate the cause of the injury.
