Jaipur: Rajasthan High Court on Monday rejected the petition submitted by Somya Gurjar challenging his suspension as Mayor of Jaipur Greater Municipality by the state government.
Hakya Bangku Pankaj Bhandari and C K Songara also uphold the constitutional validity of the provisions of the city law that enables the state to suspend the mayor of city companies.
The local self-governance department has issued orders on June 6 to suspend Gurjar, and Ajay Singh Chauhan Board member, Paras Jain (all three of BJP), and Shankar Sharma (independent) for allegedly persecuting and misusing the Commissioner of the City.
“I will submit a SLP against the decision”, Gurjar said, who had challenged his suspension and constitutional validity of the round of 39 of actions that empower the state to suspend the mayor.
The High Court argues that a mayor can be suspended even “without giving pre-audiences”.
It was said that the preliminary investigation report submitted by Deputy Director of the Department Department was true and the government acted according to the law.
The bench also observed that the state government had made a decision to conduct a judicial investigation into alleged allegations of violations by Gurjar and others, and directed that it was concluded within six months.
The Government of Congress in the state has appointed Sheel Dhabai as Mayor while Jaipur Greater Municipal Corporation.
The incident allegedly occurred when the Commissioner, Yagya Mitra Singh Deo, had gone to Gurjar’s room for attending a meeting of a problem related to the company that moved in the door-to-door garbage collection.
During the meeting, the heated argument broke out between the two and the commissioner, a civil servant, got up to go in the middle of the road.
In this midst, the council members allegedly persecuted and harassed it.
Condemning the actions against the mayor and board members, the State President of BJP Satish Poonia said the party “will fight for justice”.
