Prasagraj: In pill looking for the election of the Association of the Allahabad High Court (HCBA), a division bench from the High Court of Allahabad has suggested the parties concerned to sit together to have a friendly solution to the problem so that the bar remains functioning as a unit to work for Causes of bar members in the best way.
Hearing the Pil submitted by one Santosh Kumar Mishra, a former Joint Secretary of HCBA and four other lawyers, who were members of HCBA, a division bench consisting of the acting Chair of Munishwar Nath Bhandari and Justice AK Ojha remained on September 15.
Emphasizing the importance of the bar association, the court said, “The main object of the Association of Bars besides is working in welfare and for the benefit of members of the bar and can be fulfilled if the bar works as one entity.” In litigation of public interests (PIL), the Petitioner’s dispute is that the term members of the selected bar are one year and according to the rules of the association, one month before the end of the term, the Elder Committee must be formed consisting of a member of the Senior Bar – most of which ensure free and fair selection .
However, this year’s election has not been done even though it ends more than a year.
After hearing the parties concerned, the court observed, “suggestion of court to the parties will sit together to resolve all problems that peacefully have been accepted and therefore, both of each will run to solve the problem one by one.” “Considering Land reality and positions related to Covid-19 pandemic, they will make the right decisions in fitness cases by considering the government situation.
Given the acceptance of the court suggestion, we postpone the hearing of this petition and ordered it to be included again on September 15, 2021 as fresh, “added court.
“The parties will be expected to sit together at the right time and are expected to continue the meeting to solve the problem in the best way so that it can work in the end for the benefit of the bar,” added the last court.
The court passed this direction on September 1 that came to the center of attention on Friday.
