Patna: The Patna High Court on Friday triggered temporary assistance to Mukhiya for women who were fired (Head of Panchayat) by issuing directions to Kaiur District Judges Cum Deo that the nominated paper submitted by him to fight in the ongoing Panchayat election.
The Applicant Hiramati Devi is Mukhiya from Panchdan Panchayat on Chand Block, Kaiur.
Friday was the last day to apply for a nomination paper for the Pancrayat and the assistance was given by the bench of the Justice Division Ahsanuddin Amanullah and Justice Anjani Kumar Sharan was only a few hours before, while hearing his appeal.
Mukhiya was fired from his post after an investigation by the Secretary of the Head of the Department of Raj Pancayati on October 28, 2019 for allegedly fostering RS 33.97 lakh which was intended for development projects under the scheme of seven government resolutions.
He was considered guilty of violations in the duties of use and funding funds and thus were prohibited from fighting for five years according to the rules of 18 (6) from Bihar Pancayat Raj Act, 2006 after being fired.
Mukhiya has deposited at all Rs 35.22 lakh including a simple interest in the Panchayat Bank account in the next stage.
However, the department has ordered to recover defalkation with compound interest for that time with him.
Mukhiya has moved a high court on November 16, 2019 challenging its removal by reason of procedural irregularities.
However, a single bench denied giving him a help who observed that the main secretary of the action was true and there was no procedural irregularities.
The court also observed that Mukhiya had deposited the number along with a simple interest in Bank Gram Panchayat account after two years just to escape the punishment.
During the argument in the comparative hearing, Rajeev Kumar Singh’s advisor appeared for Mukhiya who was fired, asking the right questions in accordance with Bihar Panchayat (Office Inspection and Investigation of Affairs, Supervision and Guidelines) carried out by 2014 not carried out.
Advice also told the court that there was no orders from the DM to conduct an investigation into the Petitioner as a 2014 regulation.
Singh submitted that there was no action taken against the Secretary of Panchayat Lohand for deflectation.
He also told the court that in similar circumstances, the main Secretary of the Department of Panchayat had allowed other Mukhiyas to fight for the election by forgiving them for deflecting when they returned money.
Appearing for the state government, Dehirendra Kumar’s adviser opposed Singh’s argument while handing over all actions by the department to eliminate Mukhiya taken according to rules and regulations.
The Prima Court Facie was satisfied with the proposal’s proposal’s proposal that there was injustice with him and gave him temporary help.
The court has fixed October 7 for the final hearing on this issue where the department must also submit a reply.
The election in Lohdan is scheduled to take place on October 20.
