The Bombay High Court has provided a temporary stay in the process initiated by the local court against the Acting Alia Bhat and filmmaker Sanjay Leela Bhansali in complaints of defamation filed in connection with the film ‘Gangubai Kathiawadi’.
HC in its order on August 10 gives the interim stay until the next hearing date on September 7.
A metropolitan judge in March this year issued a call to Bhat, Bhansali and its production company Bhansali Private Limited Productions in complaints of defamation submitted by one Babuji Shah, who claimed to be the adoption of Gangubai Kathiawadi, which became the basis of the film.
The film featured Alia Bhatt as Gangubai, one of the most powerful, loved and respected mistresses of Kamathipura, Mumbai’s red light area, during the 1960s.
Shah claims this film was inspired by the ‘Mafia Queens of Mumbai’ novel.
According to Shah, some parts of the novel slandered, tarnishing the reputation of Gangbai Kathiawadi and violating their rights to privacy.
However, the senior Aabad Ponda advisor, appeared for Bhat, Bhansali and his company, argued that they had no knowledge of the existence of Shah.
The Justice Revati Mohite Dere on August 10 issued a notification to Shah and posted the application submitted by Bhat and Bhansali to hear on September 7.
“Meanwhile, until the next date, the process before the court court, Qua (regarding) applicants, live,” said the court.
In related development, other HC bench refused to provide an inap on the release of the film.
Shah has moved HC, looking for a fixed film release, and orders that hold the authors / publishers of the novel from creating third party rights or writing other stories about the life of Gangubai Kathiawadi.
Judge Nitin Sambre, in the order passed on 30 July, rejecting the application, noting that every content from the maccures slandered to death with the death of the person.
“This is for the Petitioner (Shah) to show that he is the Son of Lift Gangubai Kathiawadi who died, who failed to do Prima Facie,” Justice Sambre said.
The film was previously scheduled to be released in September 2020, but was delayed due to Covid-19 pandemic.
Earlier this year, the maker has announced that this film will be released in the cinema room in 2021.
