Jodhpur: In important decisions, the Rajasthan High Court decided that foreign nationals, who were victims of domestic violence, had the right to submit complaints if violence was carried out while living in India.
With the verdict, Vineet Judicial Kumar Mathur ignored the request of a man who had been seeking a rejection of his wife’s complaint against him by questioning his care in the field, they were foreign citizens and upholding metropolitan orders and ADJ.
Catherine Nieddu filed a complaint of domestic violence against her husband Roberto Nieddu as long as they lived in Jodhpur in 2019.
The law included foreign nationals in the definition of ‘people who were disadvantaged who were first challenged by him in the Metropolitan Court and later in the ADJ court, the ATROCITIES case woman.
With the two courts who rejected the request, Roberto moved the High Court to challenge decisions in the field that they were both not Indian citizens and could not accept jurisdiction.
In response, the respondent’s advisor said that in accordance with Part 2 (a) 2005 household violence law, the definition of ‘disadvantaged people’ including foreign nationals submitted to such violence and they had the right to apply before the trial court.
Justice Mathur observed that the respondent was a population of Jodhpur for about 25 years and had considered a marriage with the applicant.

Therefore, given the definition mentioned under various parts of the action, the court argues that the complaints of Catherine respondents can be maintained and dismissed Roberto’s petition.
“Even Article 21 of India’s Constitution expands the benefits of protection not only for every citizen of this country, but also for” people “who may not be a citizen of the country,” said the court, added that the respondent was entitled to protection.
