In the case of medical negligence, the National Commission ordered a doctor to pay compensation for Rs 10 lakh to the victim

New Delhi: National Consumer Commission, NCDRC, has directed Chandigarh-based qualified Ayurvedic and his office to pay the compensation of Rs 10 Lakh to victims of medical negligence.
The commission conducts doctors and nursing homes responsible for the diagnosis of SJ syndrome, rare and serious skin disorders, but continues to treat small patients for measles.
It also found inadequate care and doctors did not refer patients to the right specialist.
Orders were passed by benches consisting of the President of the RK Agrawal commission and members of Dr.
BC Kantikar while throwing away the petitions submitted by doctors and nursing homes.
The Sangrur Regency Consumer Commission in Punjab has issued orders of Rs 1 Lakh compensation to patients in 2010 and it was enforced by the State Consumer Commission.
While deciding to increase compensation, the Commission observed that the quantum of compensation provided by the Regency and State of the RS 1 Lakh Commission was on the lower side.
“Medical negligence in instant cases occurred in March 2009 and now we are in 2022.
The patient at a young age of 12 years suffered a very serious and potentially fatal sj syndrome.
It was a luck that he survived even though he survived.
Very inappropriate care / Inadequate at every stage.
Therefore, patients / complainants are worthy of improving and compensation that makes sense, “said the Commission.
After in detail this case, the bench observed that the doctor failed to diagnain the condition of small patients received at the nursing home in March 2009, but treat it to measles.
It was also concluded that the steroid doses provided to patients were inadequate and the choice of medicines and doses was inadequate.
The bench also found that there was a wrong delay and reference from patients with doctors, not a skin specialist.
The incident from this case came from 2009 when a 12-year-old girl was taken to the Petitioner, Dr.
BS Singla at the Chandigarh nurse house for complaints of fever, coughing and itching.
He was hospitalized.
After about 13 hours of hospitalization, there was no help and then he was referred to a drug specialist.
Drug specialists then referred to government hospitals in Patiala where health problems were diagnosed correctly and he had to be hospitalized for 18 days.
