Bengaluru: The slimming clinic in Bengaluru was ordered to return the cost collected from the doctor and also pay the RS 35,000 as compensation for trauma and physical problems that he experienced during the treatment of weight loss without results.
At the end of 13 Tummy Tuck and firming session the body, the waist of the 39-year-old child’s doctor remained the same and he only lost 1 kg.
On November 16, 2017, the pediatrician from the famous city hospital approached Vibes Healthcare Limited, a clinic that offered body slimming and beauty care, in Basavanagudi after coming across their online advertising.
Doctors, who have suffered from ligament tears and cannot exercise, visit the clinic as soon as and start a non-surgical lip session as suggested by his representative by paying Rs 17,000.
The initial weight was recorded at 66 kg and he wanted to reduce him to look slimmer for his brother’s wedding ceremony.
Even after two sessions, there were no signs of weight loss or waist reduction as promised by vibration.
When the doctor complained about the same thing, the clinic staff recommended him undergo a tummy tuck session for results.
They even gave him a discount on the opportunity for anti-obesity weeks and doctors underwent treatment after paying Rs 6,000.
Without results, the vibration staff persuaded him to five other TUCC tuck sessions for other RS 20,000.
In the end these sessions, pediatricians wanted to measure their waist with their own recording, a request that was rejected by the staff.
Finally, after 13 sessions, Bengalurean realized that he only lost 1 kg and his waist remained the same.
It drives a doctor to submit a legal notice of vibrations and approaches Bangalore Rural and Urban additional redressal district consumer disputes in Shantinagar in May 2019.
Lawyers for vibration say complaints are wrong, reckless and irritating.
He said the health care chain was famous in the country and has offered weight loss and beauty solutions for thousands of customers for two decades.
The complainant, he said, had undergone treatment after receiving all conditions, including no refund.
The lawyer said the doctor lost his weight treatment, but his food habit resulted in quickly regaining kilos.
He could not follow strict training and a diet routine as suggested and it was not a clinical error when the ligament’s torn drug could also inhibit the treatment of weight loss.
In addition, the contract signed with him was below the Delhi circle and the Bengaluru court did not have jurisdiction to hear the case, registration added.
However, on December 18, 2021, the Consumer Court decided that persecutors of professionals could not prove that failure to lose weight was caused by the treatment or diet of complainants.
The doctor approaches the clinic who believes in the guarantees given in advertising, but this type of ad is most dangerous and can have a severe impact on consumer health.
“Advertisements are misleading as it is very unpleasant, sad and clear illegal.
Advertisements must provide a clear picture of the quality of goods sold and services to be provided …
complainants, especially in this case, must be compensated,” said the judges said.
The judges decided that the health vibration represented by the MD had to return RS 34,960, the doctor’s cost of paying against slimming treatment.
Furthermore, the clinic was ordered to pay RS 25,000 women as compensation and rs 10,000 on the expenditure of the court.
